Terms and conditions of sale
The Sale is made in cash and the buyers will pay in addition to the bids, per lot and without degressivity the following expenses:
30% inclusive of tax for all Voluntary Sales or 14.28% inclusive of tax for Judicial Sales (specified for each lot).
The applicable VAT rate is 20%, except for books where it is 5.5%. VAT on expenses may be reimbursed on presentation of proof within a maximum period of one month.
Payment must be made immediately after the sale exclusively by bank transfer or credit card depending on the amounts and the country of origin of the card. Cash payments are limited in accordance with current regulations.
Cheques are not accepted.
The highest and last bidder will be the buyer subject to the auctioneer accepting the last bid and declaring the lot awarded.
The buyer will only become the owner of the auctioned item once payment has been received. The Auction House cannot be held responsible for any storage tolerated, as the item is considered to be under the buyer's exclusive guarantee as soon as the hammer is down.
In the event of a double bid recognised by the auctioneer and noted in the minutes, the item will be put up for sale, with all amateurs present and bidding live or by telephone being able to take part in this second auction.
Collection of the items may be deferred until collection and certified payment. If you are a successful bidder online, you authorise the auctioneer to use your credit card details to proceed with the payment, in part or in full, of your purchases, including the costs payable by the buyer. Estimates made prior to the sale are provided for information only.
The export or import of cultural goods may be subject to authorisations, which will be the sole responsibility of the buyer. The Auction House may assist the buyer in obtaining these authorisations.
Failure to obtain authorisation, or delays in obtaining it, shall not justify a request for cancellation of the sale.
Similarly, restrictions on the export of certain species are the sole responsibility of the future buyer.
Special conditions of sale apply to speciality sales and can be consulted on request.
STATUS OF LOTS
All lots are sold under the guarantee of the auctioneer and, if applicable, of the expert who assists him, in accordance with the descriptions given in the catalogue and taking account of the corrections announced at the time of presentation of the lot and recorded in the sale report.
In the case of antique and/or second-hand items, only the most significant accidents are mentioned in the descriptions.
Indications given by the Auction House as to the existence of a restoration or an accident affecting the lot are expressed to facilitate its inspection by the potential buyer but remain subject to his personal appreciation.
Re-leafing, parquetry or lining, which constitute a conservation measure and not a defect, are not indicated.
Dimensions are given for information only.
The absence of any indication of restoration, accident or incident in no way implies that a product is free of any present or past defect or repair. Conversely, the mention of a defect does not imply the absence of another defect. In any event, the items are sold "as is" with their imperfections and defects and no cancellation of the sale will be possible with regard to restorations and minor accidents or on the grounds of a condition that does not conform to the description.
Potential buyers are therefore invited to examine the lots that may interest them before the sale, particularly during public exhibitions, and to check that each item corresponds to the description.
For remote buyers, and in particular live buyers, the Auction House is at the disposal of future bidders to provide them with reports on the condition of the lots and additional photographs.
The request for condition reports is compulsory for buyers who do not visit the public exhibition and examine the items in person. Without a formal request for condition reports, no claim for cancellation or compensation will be possible with the Auction House, especially if the lot is described as sold "as is".
PURCHASE ORDERS
The Auctioneers and Experts are responsible for executing, free of charge, the purchase orders entrusted to them, in particular by amateurs unable to attend the sale. Purchase orders must be sent 24 hours in advance in order to be validated, provided they are accompanied by all financial guarantees and proof of identity.
Telephone line requests will only be possible above a certain amount decided by the Auction House and depending on the type of sale.
DISPATCH OF LOTS
XPEDITION OF LOTS
1. As soon as the hammer is down, the buyer becomes the full owner of his lot.
2. The objects awarded are delivered to the place of sale after full payment by the successful bidder. The Auction House may direct the latter to service providers, carriers and forwarding agents. The auctioned items are delivered to the place of sale after full payment by the successful bidder.
3. A storage tolerance of 15 days after the sale will be observed. Beyond this period, storage costs will be charged at a rate of 5 euros (excl. VAT) per day and per item.
Azur Enchères Cannes subscribes to the TEMIS Service, which enables the consultation and updating of the File of restrictions on access to auction sales ("TEMIS File") implemented by the company Commissaires-Priseurs Multimédia (CPM), a public limited company with a management board, having its registered office at 37 rue de Châteaudun, 75009 Paris, registered in the Paris Trade and Companies Register under number 437 868 425.
Any auction slip that remains unpaid after Azur Enchères Cannes or that is subject to late payment may be registered in the TEMIS file.
(1) Purpose and legal basis of the TEMIS File
The TEMIS File records incidents of payment of auction slips (late payment and non-payment), regardless of the method of participation of the bidders (face-to-face or remote) and may be consulted by all auction sales structures operating in France and subscribing to the service.
The bidder is informed that in the absence of regularisation of his bidding slip within the period mentioned on the slip, Azur Enchères Cannes may initiate a registration procedure in the said file.
The implementation of the TEMIS File and its use by Azur Enchères Cannes is necessary for the purposes of the legitimate interest of TEMIS Service subscribers to prevent unpaid debts and thus secure auction sales.
(2) Organisations authorised to consult the TEMIS File (recipients)
The TEMIS File may be consulted by any subscribing sales structure (professionals and companies authorised to conduct sales of movable property by public auction in accordance with the applicable regulations and in particular the provisions of Title II "Auction Sales" of Book III of the French Commercial Code (hereinafter the "Subscribing Professionals")) wishing to protect themselves against unpaid bills and thus secure participation in the auctions they organise. The list of TEMIS subscribers can be consulted on the site, in the "Buy at auction" menu, under the "Auctioneers" heading.
(3) Consequences of registration in the TEMIS Register
In the event that a bidder is registered in the TEMIS file, Azur Enchères Cannes may make access to the auctions it organises conditional upon the use of specific means of payment or guarantees, or temporarily refuse the participation of bidders in auctions for which these guarantees cannot be implemented.
Inclusion in the TEMIS file may result in limiting the bidder's ability to bid on auctions held by professionals subscribing to the TEMIS service. It shall also result in the temporary suspension of access to the "live" service of the platform managed by CPM, in accordance with the general terms and conditions of use of this platform.
(4) Registration period
Bidders are hereby informed that the duration of their registration in the TEMIS Register shall be determined by the number of auction slips that have remained unpaid with the Professional Subscribers to the TEMIS Register, by their cumulative amounts and by whether or not they have been regularised. The period of registration in the TEMIS Register is reduced if the Bidder regularises all the Payment Incidents. It is increased if the Bidder is concerned by several unpaid dockets registered in the TEMIS File. The registration of an auction slip as an Incident of Payment is automatically deleted after a maximum period of 24 months when the Bidder is the subject of only one registration, and 36 months when the Bidder is the subject of several registrations.
(5) Liability
For the application of the legislation on the protection of personal data, CPM and Azur Enchères Cannes are both data processors. CPM is responsible for the implementation of the TEMIS File, which includes in particular the collection of data from subscribers, the pooling and dissemination of the personal data collected therein, as well as the security of the information system hosting the TEMIS File.
Azur Enchères Cannes, as a subscriber, is responsible for its use of the TEMIS File, which includes in particular the communication of personal data relating to the successful bidders to CPM with a view to registration in the TEMIS File, verification of the accuracy and updating of the data, consultation and re-use of the information in the TEMIS File.
(6) Rights of individuals
Bidders wishing to know whether they are registered in the Register or to contest their registration may send their requests in writing, proving their identity by producing a copy of an identity document:
- For entries made by Azur Enchères Cannes: in writing to Azur Enchères Cannes, 31 Bd d'Alsace, 06400 Cannes,
- For listings made by other Professional Subscribers: in writing to Commissaires-Priseurs Multimédia 37 rue de Châteaudun, 75009 Paris, or by e-mail contact@temis.auction.
Any request for the exercise of the rights of deletion, limitation, opposition available to the Bidder in application of the legislation on the protection of personal data, as well as any other dispute concerning a registration must be addressed to the Professional who created the registration, who will request an update from CPM. In the event of difficulties, the bidder has the right to refer the matter to CPM, providing any details and supporting documents so that CPM can investigate the claim.
The bidder also has the right to lodge a complaint with the Commission nationale de l'informatique et des libertés (CNIL) [3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07, https://cnil.fr] concerning his registration in the TEMIS File. (7) Bidder's contact details
Important notifications relating to the outcome of the auction will be sent to the e-mail address and/or postal address declared by the Bidder to the structure at the time of the auction. The bidder must inform Azur Enchères Cannes of any change concerning his contact details.
